RPS 330 extension further delays pEPR reporting requirements
On 25 August, the Environment Agency extended the existing Regulatory Position Statement (RPS) 330 in England to cover data for 2026 and 2027, delaying enforcement of certain pEPR producer data reporting requirements.
While this announcement doesn’t change producers’ legal requirement to gather and report the relevant data, the regulators will not be taking enforcement action against those who comply with the descriptions set out in the RPS.
What does the extension mean?
RPS 330 previously set out that producers don’t have to collect and report on their 2025 nation of sale, carrier bag, or self-managed organisation waste data. This extension now means producers also do not have to collect and report this data for 2026 and 2027.
This reduces the regulatory burden of data collection and reporting obligations which do not impact producer recycling (PRN) or EPR disposal fee obligations.
Next steps
As this is a temporary RPS, producers are expected to start gathering this data from 1 January 2028 for the following reporting deadlines:
Self-managed organisation waste will need to be reported by large producers in line with their H1 2028 data submissions by 1 October 2028.
Nation of sale data, and plastic and paper bags supplied in England, will need to be reported by both large and small producers in line with their H2 2028, or annual 2028 data submissions, by 1 April 2029.
